    FINAL TOUCH ENTERTAINMENT SERVICE CONTRACT

    This contract for services is entered between

    (hereafter known as the purchaser) and Final Touch

    Entertainment (hereafter “Dj Final”). For your

    Thank you for selecting us for this special event. It will be our pleasure to provide Dj Services for you and your guests. Your DJ for this event will be Dj Final.

    The fee we agreed upon is

    based on up to

    hours of music or Dj Package chosen.

    A deposit of 50% of the total fee is required to reserve your event’s date upon execution of this contract. The remaining balance

    is to be paid upon Dj’s arrival at the venue. Disc Jockeys reserve the right to not commence your event without payment received upon arrival.

    and that each ½ hour beyond this end time will be an additional $75.00 per ½ hour.

    Dj Final requests ramp or elevator access between the parking/service entrance and the setup area. If equipment must be carried upstairs or lifted onto a stage to reach the setup area, an additional labor fee of $50.00 will be charged.

    The following terms and conditions apply to this agreement:

    • DJ Final shall have access to the event facility at least one hour before the music start time to set up and test equipment. Dj Final will make all efforts to have music requests available if they are received IN WRITING at least two weeks prior to the engagement.

    • The purchaser of Final Touch Entertainment services shall provide one six-foot table (skirted and covered to match guest tables if applicable) and one nearby electrical outlet.

    • DJ Final is an independent contractor and not an employee of the purchaser.

    • DJ Final uses and maintains equipment of the highest quality, however in the unlikely event that time is lost due to DJ Final equipment malfunction, DJ Final will refund the portion of the total amount corresponding to the time lost. This is the extent of DJ Final’s liability.

    • Dj Final will provide a copy of its insurance certificate upon request. The purchaser acknowledges that Dj Final may arrange for other independent contractors to cover their event. Purchaser may request a copy of such contractor’s insurance certificate. Purchaser acknowledges that DJ Final will not be responsible for any negligence caused by an independent contractor.

    • The purchaser acknowledges that DJ Final may need to use an associate disc jockey as a substitute for the contracted DJ (written above) should a situation that dictates this arises (e.g., emergency, etc.).

    • The Purchaser shall be held liable for any injury or damages to the DJ, or property of the DJ, while on the premises of said engagement if the damage is caused by Purchaser or guest, members of his organization, engagement invitees, employees, or any other
      party in attendance, whether invited or not.

    • It is understood that if this is a "Rain or Shine" event, DJ Final’s compensation is in no way affected by inclement weather. Purchaser
      shall provide overhead shelter for outside setup areas. The DJ reserves the right, in good faith, to stop or cancel the performance should the weather pose a potential danger to him, the equipment, or the audience. Every effort will be made to continue the performance. The DJ's compensation will not be affected by such cancellation.

    • If the purchaser cancels this contract less than 30 days prior to the scheduled performance, then the purchaser will be liable for the entire balance. If the purchaser cancels this contract more than 30 days prior to the scheduled performance date, then the purchaser shall forfeit the entire deposit amount.

    • The purchaser shall be liable for any and all costs, including collection fees resulting in an “insufficient funds” check and reasonable attorney’s fees and costs incurred in enforcing this contract.

    • Engagements within 60-200 miles will require hotel accommodations to be made for an overnight stay to DJ Final provided by the Purchaser. Any travels in excess of 200 miles will require transportation and hotel accommodations by the purchaser not included in the package services.

    • Purchaser may not transfer this contract to another party without the prior written consent of DJ Final.

    This contract shall be rendered void unless a signed copy of this agreement and the indicated deposit are received.
